Child Custody Laws and the Rights of Mothers

Child Custody Laws in Pakistan vary from state to state, down to the most fundamental provisions and procedures. In some states, joint custody is presumed, but not in others. Some states automatically grant sole mothers custody because they do not know who the father is until paternity is established legally. Regardless of whether the father is involved, some still require mothers who are not legally married to the child's father to file for custody. Despite the fact that the legal principle has been abolished by statute in many jurisdictions, some judges still adhere to the Tender Years Doctrine. The mother is presumed to be in charge of children under the age of 13 under this presumptive doctrine. This has changed as custody laws have changed, but some courts still follow this rule.
